RETURN & REFUND POLICY (Winamp Shop)

 

7 – PRODUCT CONFORMITY / DEFECTS – WARRANTIES

7.1 In the event that a Product delivered by Winamp S.A. (hereinafter the “Seller”) is defective or does not conform to the order, the Customer may notify the Seller:

  • by email at sav.dtoc@sna-gz.com, or

  • by registered letter with acknowledgment of receipt addressed to the Seller’s Customer Service,

within a maximum period of thirty (30) days following the delivery date of the Product.

The Customer must provide a detailed description of the non-conformity or defect and include proof of purchase (order confirmation or invoice).

The Seller shall, at the Customer’s choice:

  • either refund the full purchase price of the Product, including the initial delivery costs and the return costs (upon presentation of supporting documents), provided the Product is returned to the Seller;

  • or, where possible, replace the Product with an identical Product.

This is subject to the application of Article L.217-9 of the Belgian Code of Economic Law.

The Customer must specify their choice when submitting the claim. Failing this, the Seller will proceed with a refund.

This warranty does not apply to defects resulting from improper use of the Product by the Customer or from use that does not comply with the intended purpose of the Product.

Furthermore, the Customer is responsible for ensuring that returned Products are shipped under conditions similar to those of the original delivery, in order to cover any risk of loss or damage. Such risks remain solely borne by the Customer.


7.2 The Products offered for sale comply with Belgian legislation in force at the date of the order.

Customers located outside Belgium are responsible for verifying, with the relevant local authorities, the import and use conditions of the Products, as well as their compliance with the legislation applicable in the country of delivery.

The Seller cannot be held liable for any failure to comply with local regulations applicable to the Products in the destination country.


7.3 The provisions of this Article 7 do not affect:

  • the Customer’s right of withdrawal in accordance with Articles L.221-18 et seq. of the Belgian Code of Economic Law, as described in Article 8 below;

  • the benefit of the legal warranty against hidden defects provided under Articles 1641 et seq. of the Belgian Civil Code.


 

8 – RIGHT OF WITHDRAWAL / REFUND – EXCHANGE

8.1 In accordance with applicable legislation, the Customer has a period of fourteen (14) days from receipt of the Product(s) to exercise their right of withdrawal without providing any justification.

In the case of an order containing multiple Products, the withdrawal period begins on the date of receipt of the last Product.


8.2 To exercise the right of withdrawal, the Customer must notify the Seller within the above-mentioned period:

  • either by email at sav.dtoc@sna-gz.com;

  • or via their customer account by accessing the “Order Details” section (where applicable).

The Product(s) must then be returned by the Customer, at their exclusive expense, within fourteen (14) days following the exercise of the right of withdrawal, to the dispatch address indicated by the Seller or any other address communicated by the Seller.


8.3 Returned Products must be sent back in their original condition and packaging, particularly for CDs, vinyl records, and merchandising items, allowing the Seller to resell the Products as new.

Any Product that has been opened, damaged, altered, or shows signs of wear will not be refunded or exchanged.


8.4 In accordance with Article L.221-28 of the Belgian Code of Economic Law, audio and video recordings that have been unsealed by the Customer are excluded from the right of withdrawal.


Incomplete, damaged, or soiled Products may be subject to a partial refund only, or may be refused entirely. The Seller reserves the right to apply a depreciation to the refund amount where appropriate.

 


 

9 – REFUND – EXCHANGE

9.1 Any refund owed by the Seller pursuant to Articles 7 or 8 above shall be made within fourteen (14) days from the date on which the Seller is informed of the return or receipt of the defective Product(s).

Refunds will be issued using the same payment method used by the Customer for the original transaction, unless expressly agreed otherwise.


9.2 Refunds shall cover only the price of the returned Product(s).

The following costs are excluded and remain borne by the Customer:

  • initial delivery costs;

  • return shipping costs,

 

where the return results from:

  • the exercise of the right of withdrawal;

  • a request for an exchange confirmed in advance by the Seller.
